We hope you enjoy browsing our products and information. Whilst using this website you are agreeing to comply with and be bound by the following terms and conditions of use which together with our privacy policy that govern Smarty Party Ltd’s relationship with you in relation to this website. When you hire from Smarty Party Ltd you enter into a contract and these terms detail our responsibilities to you.

The term ‘Smarty Party’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is Greenhithe, Auckland, New Zealand. Smarty Party Limited trades as a New Zealand company. The term ‘you’ or ‘hirer’ refers to the customer who booked a Smarty Party Popup Party.

All prices are in New Zealand dollars and delivery fees are not included in the hire price. All items are subject to availability. We will inform you straight away if the items you have ordered are not available for unforeseen circumstances and offer alternative options.


Smarty Party Ltd will never pass on, sell or distribute your information to anyone else. If you choose to join our mailing list we will email you from time to time with news, upcoming promotions and general information. At any time, you can unsubscribe from our mailing list.


All material on this website and social media pages including photographs, design, layout and graphics are owned by Smarty Party Limited and are copyright. Any unauthorised use of this website is prohibited and you may be liable for damages.

All property of Smarty Party on hire must not be used for third party promotional marketing without express permission of Smarty Party. This covers social media and print.

Making a booking & the contract

To book one of Smarty Party Popup Parties or packages, you are required to complete our simple booking process. You will be guided through the process and asked to input your data to complete the transaction. Upon placing your booking, we will send you a booking confirmation email; this is to advise you that we have received your booking. After your final payment is made, it is at this point that the contract is formed between Smarty Party and you the hirer. We reserve the right to cancel a booking should there be an issue with your final payment. All bookings take place in a safe environment using the latest SSL (Secure Sockets Layer) encryption technology and a secure server.

Non Refundable Deposit

A deposit is required to secure a booking with balance being payable 7 days prior to pick up or delivery.  The deposit payment forms part of the total payment due for the hire and is different from the bond payment.


Full payment must be made prior to collection or delivery of the hire. All bookings must be made via our website and a valid NZ Visa, Mastercard or Visa Debit used at the time of booking. A $50 deposit is taken on confirmation of booking, with the balance of your party booking being deducted automatically from your credit card held securely with Stripe, 7 days prior to party date. You can learn more about Stripe and read their privacy policy at We reserve the right to cancel a booking should there be an issue with your final payment.

Refundable Bond

Visitor comments may be checked through an automated spam detection service.

A Refundable Bond of $100 is payable in cash on delivery for all hire items and will be refunded if all products are returned in same working condition as when setup. The “hirer” is responsible for the security of the equipment at all times during the hire period. Any lost, broken, damaged or destroyed equipment will be charged to the ‘hirer’ at full replacement value. To assist us in this process, we require the person who booked the Smarty Party to be over the age of 18 and MUST be there at the time of set up. You are required to inspect Smarty Party package setup along with our staff before we leave the premises. After inspection, you must initial our terms and conditions form verifying that you are happy with the quality of items and pay the refundable bond of $100 cash. When we return the following day for pack down or pickup, you or a designated adult must be there as we reinspect the Smarty Party products. If no damages are found, your $100 bond will be returned immediately.

Damages to any or all Smarty Party products include:

  • Been setup outside after our staff have left the premises
  • Been torn/slashed/ripped
  • Has come into contact with pets or water
  • Additional children used the mattresses/decor which caused subsequent damages
  • Broken/damaged tents, styling and bedding linen

All hire goods are at all times the property of Smarty Party Ltd. No Smarty Party Popup Parties or packages are to be used for any commercial situations unless there has been prior approval by Smarty Party Ltd.

Any reliance you place on such information is therefore strictly at your own discretion. Safety and Liability

Smarty Party shall not be liable in any way for any loss or damage arising directly or indirectly from the use of our products in the hirer’s home, or premises where the Popup Parties are setup. In no way will Smarty Party be held responsible for any injury or damage while products are in use by hirer.

All children using any hire items from Smarty Party Ltd must be supervised at all times by parents or caregivers, to ensure no child is injured whilst using the product. Smarty Party will not be held responsible for any injuries.

Smarty Party Ltd and staff are not liable for any claim for personal injury, death, loss of damage to the property however caused unless it is proved that such injury was caused by faulty material, workmanship, negligence on the part of Smarty Party Ltd. The business decision is final in all matter relating to these terms and conditions of hire.

Delivery and Removal of Equipment

The customer authorises Smarty Party to bring its vehicles onto their property to deliver and collect their equipment. Smarty Party shall not be responsible to the customer or any third parties for any damage that may be done to driveways, grass areas, underground services, or anything else.

The ‘hirer’ is responsible for indicating clearly the area they want the setup of the popup party to be. Smarty Party will take every care, but shall not be liable for any damage to the premises, furniture or personal belongings. The area must remain a pet free and smoke free zone at all times. All floor areas must be clean from dirt and dust before setup commences. All Smarty Party products must remain indoors.

Hire Period and Charges

The hire period commences at the time and terminates as per dates and time shown on the hire booking confirmation that the hirer receives after making their booking. Failure to return the equipment as per agreement will result in an additional charge of $500 per day until returned.

Smarty Party reserves the right to charge an additional delivery fee after the booking is agreed and confirmed if the party location is changed from its original booking address.

Acceptance of Terms & Conditions

At time of booking a Smarty Party Popup Party, the customer acknowledges all terms and conditions, and must agree to these before their booking is confirmed and payment made.
